The new regulations on port charges will be implemented from January 1, 2015

Recently,the Ministry of Transport and the National Development and Reform Commission jointly issued a notice on issues related to the relaxation of port competitive service fees,deciding to further improve port fee policies and implement market regulation of competitive service fee standards;For the convenience of practical operation,the Ministry of Transport has issued a notice on clarifying issues related to port charges,which clarifies charging standards and other issues.It is reported that the new regulations will be implemented from January 1,2015.
According to the notice,port labor fees and ship supply service fees have been uniformly changed from government guided prices and government pricing to market regulation.Among them,labor charges mainly involve container,foreign trade bulk cargo loading and unloading operations,and international passenger terminal operations;The fees for ship supply services mainly involve ship waste disposal,water supply,etc.
According to the notice,the port fee items will be simplified,and various labor fees will be charged separately according to the operation process,and will be changed to a comprehensive collection of port operation lump sum fees.In the future,container and bulk cargo charges will only retain two items:port operation lump sum fee and storage and storage fee;In addition,the operator shall not set up separate items or charge additional fees.
According to the notice,the lump sum fee for international passenger terminal operations shall be uniformly paid by international passenger and tourism passenger transport operating enterprises and shall not be charged to passengers again.
The notice also clarifies the charging standards for differentiated services in actual operations,as well as the port fees for different types of containers.
The notice requires port operators and ship service enterprises to establish a system of service and fee list,and to make it public in a prominent position on their business premises;The independently formulated and adjusted fee standards should be publicly announced at least one month before implementation,and users should be notified in writing,phone,SMS,email,and other means;It is not allowed to take unfair measures such as mandatory service fees,price discrimination,and price fraud to harm the legitimate rights and interests of users;The China Port Association should establish industry service standards and price self-discipline regulations,guide enterprises to operate legally and compete in an orderly manner,and maintain the normal price order of the industry;Transportation and pricing authorities at all levels should strengthen guidance and supervision of port operators and ship supply service enterprises in accordance with their respective legal responsibilities,and strengthen price supervision and inspection.
